Overview
These Customer Terms and Conditions (“Terms”) govern your use of our Sites and Services. By accessing or using our Services you agree to be bound by these Terms. If you do not agree, do not use the Services.
The Services
• United Safe Van Lines arranges relocation and related services through an online platform connecting Customers with independent Service Providers (e.g., moving, vehicle shipping, storage, packing, cleaning).
• United Safe Van Lines is a licensed household goods broker under FMCSA (USDOT No. [Insert], Docket No. [Insert]) and does not provide moving services directly.
• Customers obtain quotes, communicate with, and engage Service Providers through the platform; Service Providers issue estimates based on their Tariff or direct quotes.
• Customers must sign shipment documentation upon completion and note any issues, loss, or damage.
• United Safe Van Lines may terminate its relationship with a Customer with three (3) days’ notice; termination does not relieve obligations for pending Services or payments.
Modifications of Terms
United Safe Van Lines may modify these Terms at any time, effective upon posting. Continued use after changes constitutes acceptance. If you disagree, stop using the Sites and notify us to remove you from communications.
Escrow Services
• Payments are managed by third-party processors and held in an escrow account controlled by United Safe Van Lines.
• Funds are released to Service Providers upon customer-confirmed completion or after seven (7) days without dispute notification.
Funding the Escrow Account
Customers must fund the escrow account via debit or wire two (2) days before the scheduled service date. A 48-hour grace period is provided for late funding. If funds are not received, services may be canceled and charges applied, including Service Provider cancellation fees.
Payment Release
Services are deemed complete when the Customer confirms satisfactory performance. If no confirmation is provided within 48 hours post-service, funds are released unless a dispute is filed.
Cancellation and Refunds
Customers may cancel up to 48 hours before the scheduled date without fees. Late cancellations may incur Service Provider fees, deducted from refunds. Refunds for non-performance or billing errors are processed within five (5) business days after review.
Communications Monitoring
United Safe Van Lines may monitor communications (calls, emails, texts) between Customers and Service Providers through the Sites to ensure quality and compliance, per our Privacy Policy.
Phone Number & SMS Consent
• Providing a phone number is required for coordination; you consent to non-marketing calls and SMS for scheduling and updates.
• Marketing messages require opt-in; reply “STOP” to promotional texts or email admin@unitedsafevanlines.com to opt-out; service-related messages may continue.
• Phone numbers may be shared with Service Providers for coordination and are handled per the Privacy Policy.
Privacy
United Safe Van Lines monitors communications through proxy emails and phone numbers as necessary for service delivery and in compliance with applicable laws. You consent to this monitoring.
Notice for California Users
California users may contact United Safe Van Lines at admin@unitedsafevanlines.com or by certified mail to United Safe Van Lines, Inc., [Insert Address], Attn: Customer Care. They may also contact the CA Department of Consumer Affairs’ Complaint Assistance Unit.
Use of the Sites and Services
United Safe Van Lines grants a non-exclusive, non-transferable, terminable license to use the Sites for personal purposes. You may not reproduce, sell, or exploit the Sites without written consent. We may modify, suspend, or discontinue the Sites at any time without liability.
Final Review Responsibility
Customers must provide a video of their home for an itemized inventory. Customers are responsible for reviewing and approving the inventory for accuracy before it is shared with Service Providers; approval accepts responsibility for its content.
Delays and Accessibility
The Sites may experience delays or failures due to Internet or communication issues. United Safe Van Lines is not liable for resulting damages.
Registration Information
You must provide accurate, current information when creating an account and keep credentials confidential. Multiple accounts may lead to termination unless approved.
Authorized Agents
By agreeing to these Terms you designate United Safe Van Lines as your authorized agent to sign shipment documentation, confirm completion, communicate with Service Providers, make payments or adjustments, and act in time-sensitive situations when you are unavailable. You may revoke authority in writing, but prior actions remain binding.
Customer Representations and Warranties
• You represent you own or legally possess the goods and have authority to accept these Terms.
• Goods must be suitable for transport and free of hazardous or prohibited items.
• You have reviewed and approved the inventory. United Safe Van Lines is not liable for Service Provider actions or property loss/damage.
Consumer Protections
Estimates are based on Service Provider Tariffs or direct quotes and are available upon request. Physical surveys may be conducted by Service Providers; you may waive surveys but estimates then rely on provided information. You will receive FMCSA consumer brochures.
Independent Contractors
Service Providers are independent contractors, not employees or agents of United Safe Van Lines. We do not control their performance.
Payment Terms
Payments are processed through a third-party processor. You authorize charges at prices in the Service Provider’s Tariff or agreement. United Safe Van Lines charges a commission from the escrow account. Compensation disputes must be filed within seven (7) days of delivery, with payment due within thirty (30) days of resolution.
Service Provider Vetting
United Safe Van Lines vets Service Providers for ratings and ensures movers have active USDOT and MC numbers. Service Providers must comply with laws, maintain insurance and permits, and accept liability per their Tariff (minimum $0.60 per pound unless full-value coverage is selected).
Liability Disclaimers
United Safe Van Lines is a broker, not a carrier, and is not liable for Service Provider agreements or actions. Liability is limited to platform functionality issues, capped at fees paid for the specific service. Claims must be filed within three (3) days of service completion at admin@unitedsafevanlines.com. We do not provide insurance; verify coverage with Service Providers.
Inventory-Related Liability
United Safe Van Lines is not liable for inaccuracies in the itemized inventory. Service Providers rely on Customer-approved inventory; resulting issues are the Customer’s responsibility.
Data Protection and Privacy
• Data Collection: We collect personal information, service preferences, and home video/audio data.
• Data Usage: Data is used to facilitate Services, improve the platform, and comply with legal obligations.
• Data Security & Retention: Industry-standard protocols protect data; data is retained for three (3) years post-service unless deletion is requested.
• Customer Rights: You may access, correct, or delete data and opt-out of marketing. We comply with GDPR, CCPA, and other regulations. Breach notifications are provided within 72 hours.
Indemnification
You agree to indemnify United Safe Van Lines against claims arising from your use of Services, inventory inaccuracies, or breach of these Terms.
Force Majeure
Neither party is liable for delays due to uncontrollable events (e.g., natural disasters, government actions). Affected parties must notify, mitigate, and resume performance promptly. Prolonged events (30+ days) permit termination.
Dispute Resolution & Arbitration
Disputes with Service Providers follow their Tariff’s resolution process. Disputes with United Safe Van Lines are resolved via binding arbitration under AAA rules in Wilmington, Delaware, or your city of residence. Claims must be individual, not class-based. Equitable relief may be sought in Wilmington courts.
Governing Law
These Terms are governed by Delaware law, excluding conflict of laws provisions.
Entire Agreement
These Terms, along with Service Provider Tariffs and documentation, constitute the entire agreement and supersede prior understandings.
